I think throwing this man in prison for five years would be counter productive, and end up costing society more than it would get back
But the sense I get from a lot of these posts is that they think if this "kid" spends a day in jail that would also be too much, and would be showing no mercy.
To me, I would not object six months in the clink. It was felonious aggravated assault that caused serious bodily injury. It was not an accident, and had malicious intent. He didn't throw the bottle just for funzies. Part of the reason that I think he should go to jail is as a deterrent from throwing stuff at games. It lets any spectator know there can be damages and serious injury for which there will be a serious consequence. Again, not five years, but if you put some jail time on it, it will have an effect.
My other issue, that I have said elsewhere, is that he is 18. He comes from a family where he had all the advantages, and was likely taught right from wrong from a young age. Community service and a big fine paid by a weathly family are largely inconsequential.
My experience with 18 year olds, is actually pretty good. Certainly some dummies, but way more that would not have thrown a bottle into a specific crowd. I've raised teenagers that were more on the challenging side, than not. But they knew the score wrt to actions that could potentially hurt people or damage property, it wasn't hard to raise them with that knowledge. Talking about and 18 year old like they are 14 or 15 is ridiculous.
If this man came from a rough situation where right and wrong were dubious at best in his upbringing, I might feel a bit different.
