That doesn't mean every conviction would get 5 years. In fact, very few would. They base the sentence on attitude, prior criminal history, likelihood to reoffend, etc.
The sentencing guideline is 0-5 years, with up to a $5,000 fine. If convicted, it's much more likely to result in 0 time in prison and a fine for a first time offender. The bigger consequence would be having a felony conviction on his record.
But it's a big "if" that he'll be convicted. Much more likely he'll plea to a lesser offense. Or possibly some arrangement where if he keeps his nose clean for 5 years, the felony will be expunged from his record.
