If there is an accident in this scenario then both drivers should be cited

for being idiots and both causing the accident. Even if you, by law, have the right of way, both parties are responsible to avoid an accident.

In this particular scenario it would be idiotic of both parties to be in an accident if they are both starting from a stopped position and going into an intersection.
