Well what would I know, I just do this for a living.

If you advertise a "Harvey Unga" figurine, and have the figurine look like Harvey Unga, with Unga on the jersey, in the position of Harvey Unga in a famous picture, using Harvey Unga's number and every BYU fan could identify that figurine as a depiction of Harvey Unga despite the generic face ... then I don't see the judge tossing the case out on an MSJ.
