That case was about a guy that painted scenes from Alabama football games, and Alabama sued him. Alabama lost and the court ruled that artwork like that was protected under the Roger's test for trademark protection. FutureAD might (and probably would) get sued for selling his artwork, but he has a good case to win it (if he had the money to defend himself, that is).
