I'm not embarrassed at all. 20% of the settlement amount is a different thing than 20% above your costs. And good for you if you take less on occasion, shows there might be some good in there someplace, but once again even that isn't the point. One more time, your op was designed to malign other businesses for doing the exact same thing you're doing, protect themselves from losses or to protect their margins of profit.
Just an FYI, I'm not in favor of tort reform in this manner or limiting settlement amounts or even attorneys fees. That isn't really my point at all. Yes there are ridiculous lawsuits filed all of the time, and they get settled for large sums because attorneys can show the "legality" of their position. But just because something can be proved in law, or a jury can be convinced, that doesn't always make it right. Cashing in on tragedy is what's unbecoming, if you're profiting from it then you do not get to credibly claim a moral position.
