I think it’s fair. I don’t think it’s reasonable to expect more unless
you can unequivocally prove that they knew or should have known about the risk. I don’t think your statement that it was damaged when you got there would hold much weight without you documenting that you noticed it and notified them of the issue prior to the injury. I’m not a lawyer though, it’s just my opinion.

The family obviously didn’t think it was risk even though they knew it was damaged. They still chose to use the shower.
