The FTC standard (mimicked in state law) is that businesses cannot engage in unfair or deceptive trade practices. As a consumer, I tip expecting $$ to go to the employees who serve me, not the business owner. An owner who puts out a tip jar then keeps the money without sharing with employers IMO is deceiving the consumer. The state AG or even the FTC would not like this practice.
