sorry, I guess my post was FO. Rear ended by obviously poor guy. Cops came, cited him, got insurance info and gave it
to me and that was it. When I went to file with his insurance company, I learned his insurance had expired. Very frustrating to me that the police look at the card to see they have insurance but there is no verification that it is in force. If the state requires a driver to have insurance, they should also require the insurance companies to notify them when a policy lapses due to unpaid premiums. Seems to be a hole in the system.
Anyhow, in the end I had to run it through my insurance and let them try to get the guy to pay for the accident. Untimately I had to pay for the deductible and got my car fixed. My agent assured me that my insurance shouldn't go up because the Police report proved I was not at fault. But yeah, I had to pay my deductible and the insurance company never got the guy to even pay for my deductible.
