I am ONLY talking about a mole that a competent dermatologist has diagnosed as benign
Why are you introducing a hypothetical where the cosmetic surgeon "thought it was a cancerous lesion"? I'm only talking about a situation where everyone involved (patient, dermatologist, surgeon) believes the mole to be benign.

Also, assume the patient provides the cosmetic surgeon with documentation of benign diagnosis from a competent dermatologist, and the surgeon includes this documentation in the patient's medical records.
