Why is the doctor liable for failing to identify cancer in a clinically benign mole, if the patient declined biopsy?
The doctor is not liable if they do not recommend removal.
The doctor is not liable if the patient does not request removal.
If the patient requests removal of a clinically benign mole, how does that in itself create liability for the doctor, if the patient is unwilling to pay for a biopsy?
