There was a hearing recently to decide 8 planned motions.
Several days / weeks before the hearing, the Plaintiff relented on three of their objections.
Immediately before the hearing, the Plaintiff relented on two more of their objections.
Of the three remaining motions, the judge ruled in our favor on two more.
The only motion the judge overruled my team on was a motion to dismiss the Plaintiff’s complaint. My attorney stated he figured this would happen and it isn’t the end of the world. From the time I hired him, he has been very good ant educating me about the judge’s motivation to move cases along in an efficient manner. This case has been CRAWLING due to the Plaintiff’s counsel objecting to almost everything. A ruling in our favor on the motion to dismiss the Plaintiff’s complaint would have delayed the case because it would have allowed the Plaintiff another opportunity to submit a complaint (so I am told). So, my attorney felt the overruling on this motion may have been motivated by the judge’s desire to simply move the case forward without further delays.
Plaintiff is 0/1 on their motions. My team is now 9/10 on our motions!
