The contracts would award me attorneys fees. I had nothing else to “win”. So, it’s hard to ask for money plus attorneys fees when there is no way I was going to win any money anyway.

In retrospect, I likely could have held out for $500k. However, being a mediation (and negotiation) novice, the pressure that is applied by not only the mediator but also my own counsel was too much.

I think the settlement is one that I’m okay with, not overly thrilled with, but also one that the Plaintiffs is not thrilled with either. But, at the end of the day, it’s a win:win since I get my attorney fees and costs covered and the Plaintiff stopped his own bleeding.
