improperly classified as 1099 contractors instead of employees. The state has a deep interest in this classification, because of workers comp, unemployment insurance, and payroll taxes which all must be paid by an employer for employees but not for 1099 contractors. Likewise, many states have strict laws about misclassifying workers as 1099 contractors instead of employees and have agencies that enforce those laws and will pursue a wage claim on your behalf if you were misclassified.
If you were not misclassified, e.g., you were a legitimate 1099 contractor, then you should have a contract (verbal or written). If you were not paid per your contract, then your options are to settle your claim, file a lawsuit, or do nothing.
