Update on my lawsuits
I’ve posted previously about a couple of (frivolous) lawsuits I’ve been forced to endure. They are still ongoing and so I will continue to be vague about the details. But what I can say is that I’ve hired a new legal team. They are incredible! Board certified trial attorneys. They know their crap!!! Expensive as heck but a much better value proposition. The landlord is contractually obligated to cover attorney fees if I prevail, and I fully expect to prevail. Hopefully I’ll be able to recover my costs. I maintain a good relationship with my previous attorney who has offered to continue advising at no charge until the case has concluded. He won a big case years ago and collected attorney fees and he sees a clear avenue for collecting in this case. Fingers crossed. Otherwise, there is no way any of this is worth it.

The new legal team issued a dozen or so subpoena requests. I think the plaintiff felt the pressure because he promptly submitted a settlement proposal. It was ridiculous but a welcome sign that my legal team is possibly pushing the right pressure points. Depositions are upcoming and will be another pressure point on the plaintiff. I’m real excited for the depositions! I think they will be extremely revealing and things will really start coming together at that point.

My team has a clear understanding of the issues, the motives of the plaintiff, their breaches of the contract, and the frivolous nature of the lawsuits and my alleged non-material breaches.

It’s interesting how my second attorney felt the contract was poorly written such that it couldn’t really be enforced for defended. My new attorneys feel the language is “clear and unambiguous.” I don’t blame my second attorney … I’m sure he has carved out a niche for himself and this case blew up and got out of control for him real quick. I think he thought it was right in his wheelhouse at the beginning but slowly realized he was out of his league. It wasn’t until after several strategic blunders, that my new legal team is having to correct, that my second attorney recommended that we search for another team with a new strategy. The new team is working but having to correct past mistakes. For instance, the plaintiff has amended their complaint and half of the complaints stem from blunders made by my second attorney!

Anyway, a good attorney seems to be worth every penny. I guess my opinion may change but I’m in a relatively good spot right now. I’m not angry, I’m not mad. The worst part is how all-consuming this is! Lawsuits suck! I wish I could stop thinking about it, worrying about it. It’s just wasted energy. It’s a drag. But it’s also just another trial that is apart of life! Others have to endure much worse crap in life. This is weak sauce compared to others who have real trials and struggles in life.

I sure hope the good judge in our case sees how the plaintiff has weaponized the legal system in order to basically commit fraud. I hope my attorney’s are able to properly illustrate it, I hope the judge sees it and I hope she holds the plaintiff accountable. But if not, that’s okay. Life will go on.
