So clearly Gordon was driving in a way that caused a cop to stop him enough to the point that the cop thought he was endangering other people. I don't know one cop that watches a car driving straight and at a normal speed say to themselves, "I wonder if that guy is just really good at driving above the BAC limit? I should just pull him over to find out..." They generally have to have probable cause.
