I had a very discouraging email exchange with him. He took the picture but is not allowed to license it because of NCAA restrictions of some kind.

He can, however, make prints of it. After several emails, when I asked for a modest sized print for my office, he replied "I see. In that case, I'll probably decline. I was thinking you were after a large print. Not much margin in something this small. Thanks for tracking me down and at least asking permission."

So he won't give away the digital file, can't sell rights to it, and won't make prints unless you want a huge one he can charge an insane amount for. The guys is literally making no money on this photo but refuses to give it away. Go figure.
