I’m sorry but those aren’t great comparisons

I don’t text & drive or mess with controls that take my eyes off the road but I expect that those who infrequently do that only do so when they believe - right or wrong - that they can do it safely.

That’s very different from throwing a heavy object at a person below who then gets struck.
