If you are shouting in a lockerroom, do you reasonably expect that people on the otherside of a closed door won't hear you? Where the listener didn't have to do anything to hear (other than be where I expect he was supposed to be), I doubt it is a crime.
If could be fact intensive. If the recorder took measures to conceal his recording device, such that BYU reasonably believed they wouldn't be recorded . . . maybe that shades it.
