The dept of labor only protects W2 employees from my understanding. This involves people contracted to do professional work, the person who contracted the work was paid from customers, and then never paid the 1099 employees. I am looking for an agency to investigate for embezzlement but the department of labor wont touch it.

This is not a construction situation.
