My son is graduating from BYU in December and is looking to sell his contract. His complex told him that even if he finds a replacement they will charge the new tenant full rent and my son will still have to pay 85% of his rent obligation as well for the remainder of his contract. Has anyone ever dealt with this before? His rental contract states he will have to pay a "reasonable" fee for selling his contract and he/we think this is excessive.
I looked at the state rental laws for Utah and did not see any provisions/protections for subletting or transferring contracts. He is gearing up for the fight but if anyone has gone through this and have suggestions it would be appreciated.
