I fear THAT is how schools have been getting away with this.
I don't know the facts of this case, but my guess is that schools feel comfortable making promises, knowing (a) no one can punish them, (b) good performers will be incentivized to stay, even when promises don't turn out, for fear of being branded 'quitters' or 'not team players,' and (c) they are dealing with (often naive) college kids.
