I don't think it's 100% irrelevant.
I learned to drive in a state where this is legal.
Although this doesn't justify breaking the law, it does explain why it happened. This isn't a case of willful disobedience. And I do think breaking the law willfully and intentionally justifies harsher penalties than ignorance.
