Why is the 5th highest conference champion so penalized?

It should be that the 4 highest get byes and the 5th gets the 5 seed automatically and a home game against #12. As it stands now if BYU wins the Big 12 conference they would get a road game against the best non conference champ because of potentially one spot in the rankings?
